A man who was sentenced to 12 years in prison for the crime of Leandro Javier Costa Vidán, murdered by two stab wounds after an argument in a bowling alley in the Buenos Aires neighborhood of Palermo in March 2020, benefited from a reduction in sentence by the Chamber National Court of Cassation in Criminal and Correctional Matters, reported judicial sources. The resolution of Chamber I favored Antonio Santiago Ramos Chávez (40), which reduced his sentence to 10 years for the crime of "simple homicide" that the Buenos Aires Oral Criminal Court 25 gave him in May 2022. Judges Gustavo Bruzzone, Mauro Divito and Jorge Luis Rimondi rejected the claims of the official defense that "the intent of homicide" had not been proven and that it should be classified as a "pre-intentional homicide." Furthermore, the Chamber rejected the claim that the accused "acted in legitimate defense or, failing that, that he exceeded his limits," as proposed by the defender. "Not only did his conduct (Ramos Chávez) entail an absolutely disproportionate response, but there was also a provocation on his part," said Judge Divito in his opinion, which was supported by his colleagues. However, the magistrates validated the criticism regarding "the measurement of the sentence imposed" and reached an agreement for it to be reduced. The fact is that TOC 25, by the majority of judges Hugo Daniel Navarro and Ana Dieta de Herrero and with the dissent of Gustavo Goerner regarding the amount of the sentence, applied 12 years in prison. "Regarding the subsequent conduct of the defendant, I think that his presentation to the police authorities once the fact was reported should have been counted as a mitigating pattern," said Divito, who appreciated that he had not decided to evade Justice.
